ScanAbility scan results are advisory only — they are not legal ADA compliance certifications. Automated tools detect approximately 30–40% of accessibility issues. Manual testing by qualified accessibility specialists is required for comprehensive audits. The ADA Title II compliance deadline of April 24, 2026 applies to certain public entities — do not rely solely on ScanAbility reports as evidence of legal compliance.

1. Agreement to Terms

By creating an account on scan-ability.com or using any ScanAbility service, you agree to be bound by these Terms. If using ScanAbility on behalf of an organization, you represent that you have authority to bind that organization.

These Terms are governed by the laws of Delaware, USA. For disputes exceeding $10,000: binding arbitration under AAA Commercial Arbitration Rules, seated in Delaware. Either party may seek injunctive relief in Delaware courts to protect intellectual property rights.

2. Service Description

ScanAbility provides:

  • Automated scanning of web pages for WCAG 2.0 and 2.1 (Levels A and AA) accessibility issues
  • Detailed accessibility audit reports with issue descriptions, WCAG references, and remediation guidance
  • Historical scan data and progress tracking
  • ADA Title II compliance preparation tools

3. Scanning Authorization

You must be authorized to scan websites you submit. By submitting a URL, you represent that you:

  • Own the website, or
  • Have express written authorization from the website owner to conduct accessibility audits, or
  • Are performing a publicly authorized government accessibility assessment

Scanning websites without authorization may violate the Computer Fraud and Abuse Act (18 U.S.C. § 1030). ScanAbility cooperates fully with law enforcement investigations.

4. Prohibited Uses

  • Scan websites without authorization
  • Conduct bulk scanning of websites for competitive intelligence or scraping
  • Initiate scanning that constitutes a denial-of-service attack on a target website
  • Misrepresent a website's accessibility status to regulators or courts using ScanAbility reports
  • Reverse-engineer ScanAbility's scanning algorithms or access other users' data
  • Resell or sublicense ScanAbility access without written authorization

5. Subscription and Payment

Pricing displayed on scan-ability.com/pricing in US Dollars (USD).

Payments processed by Lemon Squeezy as Merchant of Record. Subscriptions renew automatically — cancel any time from your dashboard.

Failed payments: retried up to 3 times over 7 days before account suspension.

6. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

SCANABILITY DOES NOT WARRANT THAT scan results are complete, accurate, or exhaustive; that use of the service will result in legal ADA or WCAG compliance; or that identified issues are the only accessibility barriers on your website.

ADA Title II (April 24, 2026): ScanAbility provides tools to help identify WCAG 2.1 Level AA issues. Final compliance determinations must be made by qualified legal counsel. ScanAbility is not a law firm and does not provide legal advice.

7. Limitation of Liability

ScanAbility's total liability shall not exceed subscription fees paid in the 12 months preceding the event.

ScanAbility is NOT liable for: ADA, Section 508, or WCAG-related regulatory fines, settlements, or legal costs; damages from accessibility lawsuits against your websites; indirect, consequential, or punitive damages.

8. Governing Law and Arbitration

Governed by Delaware, USA law.

Disputes under $10,000: small claims court. Over $10,000: binding AAA Commercial Arbitration, seated in Delaware.

CLASS ACTION WAIVER: You agree to resolve disputes individually, not as a class action or representative proceeding.

9. Changes

We will notify you by email at least 14 days before material changes take effect.
